Residency Requirements
In
order to file a divorce in Ohio, you must have been a resident of the
state for at least six months, and of your current county for at least
90 days. If either of these do not apply, you are not permitted to
file a divorce at this time.
Things to Think About
Divorces
can be complicated and there can be a lot on the line. It is always
best to talk to a lawyer. These forms are designed to help people who
cannot afford a lawyer and have a low risk divorce. Before continuing, ask yourself these four questions:
- Do you own any real estate, including your home?
- Do you have a 401(K), and IRA, or other retirement account, including PERS or VA benefits?
- Are you entitled to a pension when you retire?
- Do you think that you may be entitled to spousal support (aka alimony)?
If
either you or your spouse would answer "yes" to any of the above, you
should make every effort to hire an attorney.
Requesting Attorney Fees
If you have been married for a long time, and if your spouse has significantly more income than you do, it is possible that the Court may order your spouse to provide you with the funds to hire an attorney. If you think this is an option that may apply to your situation, please call SEOLS at 800-686-3668 and tell the intake staff member that you are seeking assistance in filing a "Request for Attorneys Fees in a Divorce" so we can evaluate your case further.

Divorce Interview
SEOLS has developed an interactive Divorce Form Interview that we would like you to try. Instead of downloading a blank packet of all possible forms you might need for your Divorce, this program asks you simple questions about yourself and uses that information to prepare an individualized form for you. This ensures that you recieve just those documents that you need, and that the documents are filled out in a way that will be easy for the Court to follow.

More Things to Think About
Divorces
with children can be especially complicated. These forms are designed
for people that cannot afford a lawyer and who have simple cases where
there won't be a custody fight. Even in these cases, it is always best
to talk to a lawyer. If you have not done
so already, we strongly urge you to contact your local office of
Southeastern Ohio Legal Services® for a more detailed analysis of your
situation. If SEOLS is unable to offer you further assistance, we
recommend that you contact a private attorney. If you have consulted
with SEOLS and at least two private attorneys, and have decided that
you wish to pursue your case on your own, select your county to continue
