 Requesting to Waive a Filing Fee in Municipal Court


If you are filing a Complaint, Counterclaim, or Motion in the Municipal Court, it is likely that the Clerk will want to charge you a Filing Fee. This fee is actually a deposit made towards the Court Costs in your action. The Court will often waive the filing fee for low income parties who complete the affidavit below and turn it in to the Clerk.

NOTE: Even if a filing fee is waived, the Court Costs are not, and somebody involved with the case will be ordered to pay them. The advantage to having the filing fee waived is that even if you are eventually stuck with the Court Costs, they will become due only after your case is completed, and they will not prevent you from being able to participate in the Court proceedings.


Do not sign this or any other affidavit if you do not understand what it says. If you are confused about the language in this affidavit, contact SEOLS or another attorney before signing the document.
