The Pickaway County Juvenile Court has prepared the forms here to use in that Court.  Follow the below guide to find and download the correct forms for your individual case.


Before you begin, first consider whether your case should be filed in Pickaway County Juvenile Court.  Some factors to consider are:

- Are you divorced from the other parent?  If so, and the child was alive at the time of the divorce, your case may need to be filed in the Court that heard the divorce.

- Is there a previous order in another Court?  This can be tricky.  In some cases, a Juvenile Court in another county or another state will have "retained jurisdiction" meaning that your case must be filed there even if nobody lives in that county or state any longer. 

- Where does the CHILD live.  If neither of the above two points apply, If you live in Pickaway, but the child at issue lives in Jackson, you need to file in Jackson.  If you and the Child live in Jackson, and the opposing party lives in Pickaway, you still need to file in Jackson.

- If you cannot determine on your own where your case should be filed, consult an attorney before filing paperwork.



Step 1: download the instructions file and the general forms files:

UCCJEA - This is an Affidavit listing information the Court must have regarding your child before your case can be opened.  It must be filed in each and every case before the Juvenile Court.  You can also complete this form using an interactive interview program.  Click here to learn more.

Waiver of Service - Use this form if everyone who needs to be given notice that the case has been filed wishes to waive the right to formal notice.  This will speed up your case as the Court will not need to wait until formal service has been acomplished.  

Request for Service - Use this form if there is anyone who needs to be "Served."  This means they need to be given notice the case has been filed.  At a minimum, you must Serve 1) both natural parents if living, 2) any person who has legal custody of a minor child that is at issue in your case, and 3) any person you wish to prove is the father or wish to prove is not the father of the child.   You do not need to request service as to any person who signed the Waiver of Service, above.

Notice of Hearing - This is the form the Court will use to tell you when your hearing is scheduled.

Affidavit of Indigency - Use this form if you are unable to file your case if the Court requires you to prepay a filing fee in order to do so.  NOTE: the Court will NOT waive the fee altogether, but you can ask that the Court delay it until the case is complete instead of making you pay it up front.


Step 2: Determine whether you need to file a Motion or a Complaint.

         A Motion should be filed if the Pickaway Juvenile Court has already considered a case involving the same child(ren).  For example, if you want to change a previous custody order, a previous child support order, or a previous visitation order that was issued by the Pickaway Juvenile Court.  

          A Complaint should be filed if the Pickaway Juvenile Court has never considered a case involving one or more of the children involved.  This includes cases where there was an order from some other Court, but you have determined that you need to file your current action in Pickaway County.

Step 4: Complete the Forms.

COURT POLICY ON PRO SE FILINGS

Effective immediately, the Court establishes the following policy for individuals wishing to file their papers without an attorney:

Legal Aid will review your documents that you wish to file to make sure they meet court requirements. However, Legal Aid is Not your attorney at that time.

The Court cannot prevent you from filing a paper without such review. However, if you do not take advantage of this review and the paper is filed improperly, the case will be dismissed immediately and no court costs will be refunded.

Therefore, it is strongly suggested that you use the review opportunity and appear at the Courthouse for a Packet Clinic.  Contact SEOLS at 800-686-3668 or the Pickaway County Juvenile Court at (740) 474-3117 to find out when the next Packet Clinic will be held.
